AGREEMENT FOR USE OF BALDWIN COUNTY PUBLIC SCHOOL FACILITIES

1.
Facility User will be present for the duration of the use of the building. Failure to do so will result in no further use of the facility.

Facility User understands that the Board’s facilities, grounds or equipment are being provided to Facility User on an “as-is”, “where-is” and “with any and all faults” basis, without representation or warranty, whether express or implied, of any kind whatsoever.

Facility User agrees to review and be responsible for following all relevant federal, state, and local laws.

Facility User agrees to abide by any Board policies and procedures related to COVID-19, including but not limited to those regarding group gatherings and events and any requirements pertaining to social distancing (6 ft), face coverings, hygiene, sanitizing, symptom checks, and screening procedures. Facility User agrees, at its sole cost and expense, to be solely responsible for developing and enforcing proper protocols and procedures, and otherwise ensuring compliance with all BCBE Covid-19 requirements.

Children not participating in the activity are not allowed in the facility unless accompanied by a parent who is not participating in the activity.

During Facility User’s use of Board facilities, Facility User and its employees, volunteers, participants, partners, officers, members, agents, contractors, customers, guests, family, heirs, staff, invitees, and spectators (collectively and individually, “Facility User Group”) are limited to the room(s) rented, the hallway leading to the room(s), and the nearest restroom(s). To ensure that surfaces from a cleaned room stay clean until students arrive, it is imperative that your group only use the room(s) previously approved and designated for use. No one is allowed to walk/roam through facility.

No food is allowed in the facility.
8.
Those who have activities logged on the school calendar will have priority in use and any school function takes highest priority in scheduling.
9.
Facility User acknowledges and agrees that the proposed facility use is not sponsored by or endorsed by the Board, the principal, the local school trustees, the school or any official or employee of the Board.
10.
Facility User understands and acknowledges that, due to the ongoing COVID-19 pandemic, there are certain risks inherent in visiting public spaces, such as the Board’s facilities and grounds, and/or engaging in activities, gatherings, or events with or within proximity of others, including, without limitation, accident, personal or bodily injury, illness, viral or bacterial exposure or infection, and/or death, and that engaging in such activities may be dangerous. Facility User agrees that the Board cannot ensure the safety of Facility User Group. Facility User Group HEREBY ACKNOWLEDGES AND ASSUMES FULL RESPONSIBILITY FOR AND RISK OF ACCIDENT, PERSONAL OR BODILY INJURY, ILLNESS, VIRAL OR BACTERIAL EXPOSURE OR INFECTION, AND/OR DEATH to Facility User or any member of Facility User Group from, or in any way associated with, COVID-19 or other related or similar pandemic that directly or indirectly results from, arises out of, or in any manner is connected with Facility User’s or the Facility User Group’s use of or presence in, upon, or about Board facilities, grounds, property, or equipment. This assumption of responsibility and risk includes, without limitation, all KNOWN AND UNKNOWN RISKS AND DANGERS, INHERENT OR OTHERWISE.
Facility User agrees to “hold harmless” the Board, its members, the Superintendent, the principal, the local trustees and all agents or employees of the Board from any liability, including attorney’s fees (1) for negligence or any other wrongful acts of Facility User or Facility User Group, and/or (2) for permitting the use of such facilities.
11.
I understand that by signing this agreement, I acknowledge and agree to all of the above provisions, and I assume full responsibility for damages and cleanliness to any part of the facility until the principal/designee inspects the facility. I also affirm that appropriate liability insurance is in place.
*A Fee may be charged for the use of facilities. All areas where electricity is needed will be charged a mandatory "County Fee".
(Example: Gym, cafeteria, classrooms, etc. Also, athlectic facilities where lights are needed.)

Facility User agrees to take out and carry liability insurance, in an amount to be determined by the Superintendent, naming the Board, its members, the Superintendent, the principal, the local trustees and all agents or employees of the board as additional insured’s. Facility User agrees to provide to the Superintendent, as appropriate, a certificate verifying appropriate insurance coverage prior to use of facility.
13.
Facility User agrees that the facilities will not be used for any purpose not permitted by this Agreement and/or Board Policy.
14.
Facility User agrees to be held responsible for any costs incurred by the Board due to damage, the need for excessive clean-up, or repair and/or replacement to property. The Board reserves the right to charge additional fees when a user group leaves the facilities in such condition that additional cleanup and repair is needed prior to the next scheduled use of that facility.
15.
Facility User agrees that it will be responsible for cleaning up the area of the facility used. Because of COVID-19 restrictions, however, Facility User understands that a mandatory COVID-19 “Sanitation fee” will be charged in order to cover the cost of custodial cleaning/sanitizing of the area used if the use time is outside BCBE normal business hours. If the custodial staff must work extra hours for the cleaning/sanitation process, then the Facility User will be charged $35.00 per hour. The site administrator has the discretion to assess an additional fee, as part of the “school fee”.
16.
Facility User understands that the Board may terminate this Agreement immediately and without notice if it is found that Facility User has failed to comply with the terms of this Agreement and/or failed to follow federal, state, and local government laws and Board policies and procedures, including but not limited to those Board policies and procedures related to COVID-19.
17.
Facility User understands that the Board reserves the right to cancel this Agreement at any time. All use of schools by outside groups is automatically cancelled when schools must be closed due to inclement weather or other conditions. Facility User may cancel this agreement in the event of a COVID-19 related reason. In the event that this Agreement is cancelled as provided herein by the Board or Facility User, Facility User will be refunded for the amount paid.
**A COVID-19 related cleaning/sanitation fee may be charged as a “Sanitation Fee” for custodial services if needed.
